Judge asks govt to declare collapse of civil justice system


ISLAMABAD:

Justice Jamal Khan Mandokhail has observed that the government should send all cases to military courts for adjudication after declaring that the civil system has collapsed.

Justice Mandokhail is a part of a seven-member constitutional bench of the Supreme Court, which on Monday resumed hearing the intra-court appeals filed by the government against an earlier order of the apex court, annulling trial of May 9 rioters in military courts.

Attorney-General for Pakistan (AGP) Mansoor Awan began his arguments in support of the intra-court appeals and noted that giving the right to appeal to the people convicted by military courts is a policy matter, on which he would make submissions after receiving instruction from the government. Justice Mandokhail stated parliament should look into the policy matters and that the CB is supposed only to limit itself to the instant case. “They should also take this policy decision that the civil system has failed and all the cases should now be sent to military court,” he said.

AGP Awan stated that he would present arguments on three points. “The lawyer for the Ministry of Defense, Khawaja Haris, has already given arguments regarding the events of May 9, 2023.

The court adjourned the hearing of the case till May 5.
